FRA clarifies “Smartwatch” Rule – Fitbits restricted

The question?
May an employee wear a device like a “Garmin Vivofit” or “Fitbit” wristband that acts like a watch, and counts the steps that an individual takes each day?  The devices are not searching for the internet, or Wifi, to do this and must be synchronized with Bluetooth on a separate device. The devices are essentially digital watches and track the number of steps an individual takes each day in the background. Does the FRA consider these devices “smart watches”? 

FRA considers Fitbits and similar devices to be “personal  electronic devices” that are subject to the restrictions in part 220. Per the definition of an “electronic device” at 49 CFR 220.5, they are an electronic device that performs functions not necessary for the health or safety of that person and entail the risk of distracting employees from safety-related tasks.

FRA understands some Fitbit devices are rather limited in their functionality. However, a number of different fitness tracking devices are available. The Fitbit Blaze, for example, has functions that include mobile playlists, call alerts, text alerts and fitness tracking. These functions are the same type of distracting functions that have caused railroad accidents and were the impetus for the restrictions contained in part 220.

The regulation text of part 220 does not distinguish between Fitbits that have limited functionality, and those that are more akin to smartphones or smartwatches. Unless a waiver granting an exemption for certain fitness tracking devices with limited functionality were issued by FRA in the future, the agency considers all such devices to be “personal electronic devices” that are subject to the restrictions in part 220.  However, railroad operating employees are allowed the use of digital clocks or wristwatches whose primary function is to tell time.

Timepieces are commonly used in the railroad industry to verify the accuracy of a locomotive’s speed indicator. This function is safety-related in that it accurately allows a train crew to comply with relevant track speed limits during the course of a train’s movement. This exception is limited to those wristwatches that do not have functions which violate the requirements set forth under 220 subpart C. The Primary function of fitness tracking devices is not to tell time.

As stated in Title 49 CFR 220.303, a railroad operating employee shall not use an electronic device if that use would interfere with the employee’s or another railroad operating employee’s performance of safety-related duties. No individual in the cab of a controlling locomotive shall use an electronic device if that use would interfere with a railroad operating employee’s performance of safety-related duties.

The exceptions within 220 subpart C account for varying operating situations, with particular flexibility for railroad supplied devices. 

The only exceptions within 220 subpart C are specially stated in § 220.309:

§ 220.309 Permitted uses; exceptions to other restrictions.

Notwithstanding any other limitations in this subpart, a railroad operating employee may use the following, if that use does not interfere with any employee’s performance of safety-related duties—

(a) The digital storage and display function of an electronic device to refer to a railroad rule, special instruction, timetable, or other directive, if such use is authorized under a railroad operating rule or instruction.

(b) An electronic device as necessary to respond to an emergency situation involving the operation of the railroad or encountered while performing a duty for the railroad.

(c) An electronic device to take a photograph of a safety hazard or a violation of a rail safety law, regulation, order, or standard, provided that—

  1. A camera that is part of a cell phone or other similar multi-functional electronic device is not included in this exception unless it is a railroad supplied device and is used for an authorized business purpose;
  2. The camera, unless otherwise permitted, is turned off immediately after the documentation has been made; and
  3. If the camera is used in the cab of a moving train, the use is only by a crewmember other than the locomotive engineer.

(d) A stand-alone calculator if used for an authorized business purpose.

(e) A medical device that is consistent with the railroad’s standards for medical fitness for duty.

(f) A wireless communication device to conduct train or switching operations if the railroad operating employee is part of a crew assigned to a train that is exempt under § 220.9(b) from the requirement of a working radio when the employing railroad has fewer than 400,000 annual employee work hours.

Additionally, railroads may impose more stringent requirements that are subject to change at the railroad’s discretion, without notice to FRA, and can vary from railroad to railroad.

Protect Your Fellow Members

I urge all members to please protect our work. If you are on a rest day and are available to work, but not on a supplemental list, call the crew callers and let them know. We have many trains that are running short handed due to staffing issues, this puts the crews who are working these trains at a safety disadvantage. The assaults on train crews have risen dramatically lately and more staff on the train is good for our members and for the passengers. Please make yourself available to work so ALL crews are fully staffed. I ask that all crew members who were issued radios, please follow the rules and carry them at all times. If you were never issued a radio send me an email, I will get one assigned as soon as possible. We need to protect our work and each other, being on the property helps us all.

Weekend Storm

Our GC has had talks with the DGM of transportation on the upcoming inclement weather, all employees scheduled to work Saturday 1-23 & Sunday 1-24 please sign up at your regularly scheduled on duty time, regardless of media reports on the rail system being shut down we are to report. Managers will be at sign up locations to direct members and record attendance upon arrival. Please use caution and common sense when traveling and if you do not think roads are safe stay home. Also if you are unable to make it inform the crew callers or call your sign up location and ask for a supervisor.

UPDATE>>>>>>>

WE just got the call NJT ordered to shut down service at 2am or after last train arrives back original terminal. Crews will still be required to report to their regular sign up locations at their regular times, they plan on running trains without passengers through the outage to keep tracks clear as necessary. They also want to have the crews on site to start service back up as soon as possible. Crews are to report to supervisors at terminals for instructions on how prep for their runs.

Update 7:00 pm Saturday;

Service will resume on the NEC and DO (Midtown Direct) at noon tomorrow, all other lines will be evaluated for a noon opening. If possible please report for your assignment and if travel is not safe please contact a supervisor or crew dispatcher for direction. Numbers are below and you can always call the ACD (Chief dispatcher) they will be able to help you.

PEB 249

President Obama has appointed Presidential Emergency Board (PEB) 249 to make non-binding recommendations to settle the outstanding contract dispute between New Jersey Transit (NJT) and the coalition of all the unions.

The three member Board will be chaired by arbitrator Joshua Javits, who also served as Chairman of the second Long Island Rail Road PEB last year. 

The PEB will hold hearings starting December 14 in Newark. Each side will submit their complete proposal for a contract, and the Board will choose what it considers the most reasonable offer as its recommendation. The Board decision is due no later than January 11, 2016.

Attached is the PEB recommendation this is our first step in securing a new agreement and the consensus is favorable, it is a big document so we will be reviewing and checking our numbers but we wanted to get it out to members ASAP. Please remember this a recommendation from the PEB and not an offer from the carrier some points can and will be negotiated. Please read the document and become familiar with the RLA  process, and the stage we are currently at. This is far from being resolved but we are one step closer to having a agreement with NJT.

We just received the PEB report and overall the results appear good.  Bottom line is 18.38% compounded wage increases over 6.5 year term, and 17.54% increases net of health and welfare contributions.

Key Principles for New Transit Authorization Bill

Today our GC along with some of your local 60 officers and members, including other union represenatives, stood with Senator Menedez U.S. Senator (D-NJ) in support of a new transportation authorization bill, he unveiled key principles for public transportation and Local 60 is in agreement with our Senator with this legislation and encourage members to support it.

 

“I categorically reject the idea that we can’t afford to fix our transportation system; we can’t afford not to fix it,” said Sen. Menendez, Ranking Member of the Subcommittee on Housing, Transportation, and Community Development, which has jurisdiction over transit. “Let’s stop pretending the transportation problem is going to resolve itself if we just wait long enough. Hundreds of thousands of New Jersey families and millions of Americans rely on a safe, reliable, affordable transit system, and Congress must finally accelerate on real investments and stop putting the brakes on upgrades, innovations and protections.”

“Senator Menendez is a true champion for the commuters of NJ Transit,” said Steve Burkert, General Chairman of SMART-Transportation Division Local 60, which is a member of the NJ Transit Rail Labor Coalition. “We applaud the Senator’s efforts to gain long term funding for NJ Transit. Rally to support Public Transportation Reauthorization Bill

Senator Bob Menendez will be holding a rally tomorrow at 11:00am at the Ridgewood train station. A handful of your SMART-TD officers will be in attendance and encourage any member who is available to attend. He is promoting legislation that directly affects us and our family’s. This is an important step in getting politicians in Trenton to recognize we are aligned with them and we need their support.
